3.2.5. Members of the governing board can be dismissed only for cause and by due process.

NARRATIVE/JUSTIFICATION FOR JUDGMENT OF COMPLIANCE
Northeast Alabama Community College demonstrates compliance. The Alabama State Board of Education is the governing board of the college. Alabama State Law (Code of Alabama, Section 16-3-4) provides for the removal of a State Board of Education member by the Governor "...for immorality, misconduct in office, incompetency or willful neglect of duty..." Upon the removal of a board member by the Governor, the board member must be given "...a copy of the charges against him and, upon not less than 10 days' notice, an opportunity of being heard publicly in person or by counsel in his own defense." The Governor must follow due process by filing appropriate statements and records with the office of the Secretary of State.
